The Personal Data Protection Act 2010 (hereinafter referred
to as the “PDPA”), which regulates the processing of personal
data in commercial transactions, applies to LUMENZ TAX ADVISORY
SDN BHD (hereinafter referred to as “our”, “us”
or “we”). For the purpose of this written notice (“Notice”),
the terms “personal data” and “processing” shall
have the meaning prescribed in the PDPA.
- This Notice serves to inform you that your personal data is being
processed by us or on our behalf and you hereby give your consent to
the processing of your personal data.
- The personal data processed by us may include your name, date of
birth, gender, nationality, national identity card (NRIC) number, passport
number, copy of passport, contact number, address, email address, designation,
company name, tax registration documents, photographs, and all other
details provided by you to us from time to time and all other personal
data we again collect from you on any subsequent occasion.
- Your personal data is being or is to be collected and further processed
by us for the following purposes (where relevant):
- performing pre-contractual activities and our contractual obligations
with you and ensuring the performance by you of your pre-contractual
activities and contractual obligations to us;
- providing and improving our services to you;
- communicating with you, dealing with your inquiries or complaints
and resolving any issues/disputes;
- obtaining professional advice and enforcing our rights;
- internal management and administrative purposes;
- advertising and providing you with information relating to our services
including without limitation sending you e-newsletters, promotional
and marketing materials;
- complying with any legal or regulatory requirements and/or directions
and instructions from any law enforcement officer or any governmental
and regulatory bodies;
- inviting you to participate in our events, programmes and other
activities organised or sponsored by us or on our behalf; and/or
- such other purposes authorised by you or directly related or ancillary
to the foregoing.
(“Purposes”).
- Your personal data is and will be collected from you and/or from
a variety of sources, including without limitation, from the information
you have provided to us in your emails, any form submitted or filled
in by you or on your behalf, any correspondence with us, all other communications
between us and you, your organisation, your organisation’s authorised
representatives or advisors, third parties including but not limited
to our service providers and referees, and all other information that
you may provide to us from time to time.
- You may request access to, and request for correction of, your personal
data and contact us with any enquiries or complaints in respect of your
personal data as follows:

In accordance with the PDPA:
- We may charge a prescribed fee for processing your request for access
or correction; and
- We may refuse to comply with your request for access or correction
to your personal data and if we refuse to comply with such request,
we will inform you of our refusal and reason for our refusal.
- Your personal data may be disclosed to third parties such as but
not limited to regulatory and/or statutory bodies, governmental departments
and/or agencies, our related corporations, our business partners, suppliers,
service providers and contractors and any such third party requested
or authorised by you for any of the above Purposes or any other purpose
for which your personal data was to be disclosed at the time of its
collection or any other purpose directly related to any of the above
Purposes.
- You may limit the processing of your personal data or request us
to cease or not begin processing your personal data for purposes of
direct marketing and/or withdraw your consent previously given to us
(in full or in part) by providing us with a notice in writing. Do note
that if you limit the processing or withdraw your consent to any or
all use of your personal data, we may not be in a position to continue
to administer any contractual relationship in place, which in turn may
result in us being unable to provide you with any of our services and/or
the termination of any arrangements/agreements with us.
- If you fail to supply to us the personal data indicated as compulsory
by us, we may not be able to process your personal data for any of the
above Purposes.
- Your personal data may be transferred to a place outside Malaysia
and you hereby consent to such transfer.
- You are responsible for ensuring that the personal data you provide
to us is accurate, complete and not misleading and that such personal
data is kept up to date.
- We may request your assistance to procure the consent of third parties
whose personal data is provided by you to us and you agree to use your
best endeavours to do so.
- In the event of any inconsistency between the English version and
the Bahasa Malaysia version of this Notice, the English version shall
prevail over the Bahasa Malaysia version.
